Agreement to Terms

By accessing or using www.firepits.com (“the Site”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Site.

Products and Pricing

FirePits.com is an authorized dealer of premium outdoor fire and heating products. All products are sourced directly from manufacturers and carry full manufacturer warranties. Prices are listed in US Dollars and are subject to change without notice. We reserve the right to correct pricing errors.

Orders and Payment

• All orders are subject to acceptance and product availability
• Payment is processed securely through Square or PayPal at the time of purchase
• We reserve the right to refuse or cancel any order for any reason
• You agree to provide accurate and complete payment and shipping information

Shipping and Delivery

• Shipping times vary by product and are estimates, not guarantees
• Many of our products are made-to-order and require 2-6 weeks for production
• Free shipping is available on qualifying orders (see product pages for details)
• Risk of loss transfers to you upon delivery to the carrier
• White-glove delivery is available for select products and includes placement in your outdoor space

Returns and Refunds

• Returns are accepted within 30 days of delivery for unused, undamaged products in original packaging
• Made-to-order products and custom configurations are not eligible for return
• Return shipping costs are the responsibility of the buyer unless the item is defective
• Refunds are processed to the original payment method within 5-10 business days of receiving the return

Warranties

All products carry the manufacturer's warranty as specified on the product page. As an authorized dealer, warranty claims are handled through us — contact us and we will coordinate with the manufacturer on your behalf. Warranty coverage varies by brand and product.

Intellectual Property

All content on this Site — including text, images, logos, and design — is owned by FirePits.com or our content suppliers and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

User Accounts

• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity under your account
• We reserve the right to terminate accounts that violate these terms

Limitation of Liability

FirePits.com is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products. Our total liability is limited to the amount you paid for the specific product giving rise to the claim.

Communications and Marketing

By creating an account, you agree to receive transactional communications (order confirmations, shipping updates, password resets). Marketing communications (new products, promotions) are only sent if you explicitly opt in during registration or via our newsletter. You may unsubscribe from marketing at any time by clicking “Unsubscribe” in any marketing email.

Accuracy of Information

We strive to display product images, descriptions, and specifications as accurately as possible. However, due to the handcrafted nature of our products and variations in display settings, actual products may vary slightly from images shown. Fire features with natural patina finishes (Corten steel, copper) will develop unique characteristics over time.

Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at kade@firepits.com. If we cannot resolve a dispute within 30 days, either party may proceed with formal resolution.

Governing Law

These terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Multnomah County, Oregon.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to Terms

We may update these terms at any time. We will notify you of material changes by posting a notice on our site. Continued use of the Site after changes constitutes acceptance of the new terms.
